GavelHop is an auction listings service operated by 2616232 Alberta Inc. We publish when auctions are happening and who's running them. We're not the auctioneer, we don't guarantee the listings are correct, and you use the information at your own risk. Alberta law governs this agreement. No refunds. Cancel anytime at the end of your paid month.
These Terms of Service (the "Terms") form a binding agreement between you ("you," "your," or "Subscriber") and the legal entity and service provider described below.
GavelHop is a product and service provided by 2616232 Alberta Inc. In this Agreement, "2616232 Alberta Inc." (or "the Company"), "we," "us," and "our" refer to 2616232 Alberta Inc., an Alberta corporation incorporated under the Business Corporations Act (Alberta). All business, contracts, payments, and obligations under these Terms are with 2616232 Alberta Inc., not with "GavelHop, Inc." or any other entity. GavelHop is the product/service name for 2616232 Alberta Inc.'s auction-listing service.

By creating an account, subscribing, or otherwise accessing the Service, you represent that you are at least eighteen (18) years of age, that you have read and understood these Terms, and that you agree to be bound by them in their entirety.
2616232 Alberta Inc. (operating as GavelHop) provides an online subscription service (the "Service") that aggregates and displays publicly-available information concerning upcoming auctions in certain Canadian provinces, including but not limited to auction dates, locations, types, and auctioneer contact information. The Service is informational in nature.
The Company does not operate, organize, host, conduct, promote, broker, or facilitate any auction, auction sale, or any transaction arising from an auction. We are not party to any auction. All responsibility for the conduct, fairness, and legality of any auction rests solely with the operating auctioneer.
You may select either (a) the Single-Province plan at CAD $2.99 per month, or (b) the Three-Province plan at CAD $5.99 per month, in each case exclusive of applicable goods and services tax (GST) and provincial sales taxes, which will be added to the amount payable at the rate prescribed by law. Your selection of provinces determines which auctions you will see in the Service.
Each subscription term is one calendar month. The first term begins on the day of signup and ends at 23:59:59 Mountain Time on the same day of the following calendar month (the "Anniversary Day"). Each subsequent term begins immediately upon expiry of the previous term and ends at 23:59:59 Mountain Time on the Anniversary Day of the next calendar month. Subscription terms automatically renew on each Anniversary Day unless cancelled in accordance with Section 4.
Where the target month contains no day matching the Anniversary Day (for example, a subscription signed up on the 31st of January), the term ends on the last day of the target calendar month.
Fees are charged in advance at the start of each term in Canadian dollars through the payment processor we designate. You authorize 2616232 Alberta Inc. and our payment processor to charge your chosen payment method for all fees, taxes, and charges payable under these Terms. Your payment method will be charged today and on every anniversary thereof until your subscription is cancelled.
We may change fees for future terms by giving you at least thirty (30) days' notice, electronically or by updating this document. Your continued use of the Service following the effective date constitutes acceptance of the revised fees. If you do not accept the new price, you may cancel your subscription before the increase takes effect.
No refunds. All fees paid to 2616232 Alberta Inc. are final and non-refundable, in whole or in part, including where the Subscriber has not used the Service, has been unable to access the Service for any period, or is dissatisfied with the Service.
You may cancel the subscription at any time via your account settings on the Service. Cancellation takes effect at the end of the then-current paid monthly term. No pro-rata refunds or credits are issued for partial months. Refunds are not available even if the Service becomes unavailable through no fault of your own.
Auction information displayed on the Service is compiled from third-party websites, public listings, and automated data collection ("scrapers"). Auction events may be cancelled, postponed, relocated, consolidated, or modified by the operating auctioneer at any time, without notice to the Company. Auctioneer contact information may become outdated. Auction descriptions, lot counts, times, and types may be incorrect, incomplete, or out of date.
2616232 Alberta Inc. makes no representation or warranty, express or implied, as to the accuracy, currency, completeness, reliability, or suitability of any information displayed on the Service. You are solely responsible for independently verifying any auction date, time, location, lot, or detail with the operating auctioneer before relying upon it, including but not limited to travelling to an auction site or committing funds.
Nothing on the Service constitutes financial, legal, appraisal, bidding, investment, tax, or other professional advice. The Service is a simple informational aid. You are solely responsible for all decisions arising from the use of the Service, including without limitation the decision to attend any auction, bid any amount, purchase any asset, or forgo any opportunity. Do not rely on the Service for investment or financial decisions.
The Service is provided "as is" and "as available," without warranty of any kind, either express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted availability, or freedom from defects, viruses, or errors. To the maximum extent permitted by law, 2616232 Alberta Inc. disclaims all such warranties.
We do not warrant that the Service will be secure, uninterrupted, or error-free. We do not warrant that any information is timely, accurate, or complete.
To the maximum extent permitted by the laws of Alberta and Canada:
You agree to indemnify, defend, and hold harmless 2616232 Alberta Inc., its operators, contractors, and affiliates from and against any and all claims, demands, actions, proceedings, damages, liabilities, losses, costs, and expenses (including reasonable legal fees on a solicitor-and-own-client basis) arising out of or in connection with:
By using the Service, you acknowledge and consent that 2616232 Alberta Inc. collects and processes personal information about you, including without limitation your username, email address, hashed password, IP address, user-agent string, approximate geographic location derived from your IP address, subscription history, session tokens, and audit logs of account activity. This collection is carried out in accordance with the Personal Information Protection and Electronic Documents Act (Canada) ("PIPEDA") and the Personal Information Protection Act (Alberta) ("PIPA"). Full details are set out in our Privacy Policy, which forms part of these Terms.
2616232 Alberta Inc. reserves the right to identify your approximate location and any other data about you that we are legally permitted to collect and process under Canadian and Alberta law for the purposes of service delivery, fraud prevention, billing, compliance with legal obligations, enforcement of these Terms, and any other legitimate business purpose.
You agree not to:
2616232 Alberta Inc. may suspend or terminate your account at any time, with or without notice, for any reason, including without limitation breach of these Terms, non-payment, suspected fraud, or abusive conduct. Upon termination, your right to access the Service ceases immediately. Sections 5–9, 11, 14, and 15 survive termination.
2616232 Alberta Inc. may amend these Terms from time to time by posting the revised version on the Service and updating the "Last updated" date above. Material changes will be communicated by email or by prominent notice on the Service at least thirty (30) days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
These Terms and any dispute arising out of or in connection with them or with the Service are governed exclusively by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You and 2616232 Alberta Inc. irrevocably attorn to the exclusive jurisdiction of the courts of the Province of Alberta sitting in the City of Calgary for the resolution of all such disputes, save that 2616232 Alberta Inc. may seek injunctive or equitable relief in any court of competent jurisdiction.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and 2616232 Alberta Inc. and supersede any prior agreement or communication.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
No failure to enforce any provision constitutes a waiver of that provision or of any other provision.
You may not assign these Terms. 2616232 Alberta Inc. may assign these Terms in connection with a corporate reorganization, merger, or sale of assets.
Notices to you will be given by email to the address on your account or by posting on the Service. Notices to 2616232 Alberta Inc. must be sent to legal@gavelhop.ca.
